Take That 'Golden Tag' Promotion on Shazam - How Does it Work?

The promotion runs from 8 October to 21 November 2010 and is open to registered Shazam users on iPhone and iPod Touch, who are UK residents over the age of 18 years. No purchase is necessary to be entered into the promotion.

  1. Participants should ensure that the Shazam Application is downloaded onto their iPhone or iPod Touch from iTunes.*
  2. Participants register with Shazam, by tapping on the 'settings' tab on the downloaded App and checking their 'signup' status. It's simple to signup, just enter an email address and a password.
  3. Participants then listen out for Take That's new single, 'The Flood' and 'Shazam' the track to automatically be entered into the Golden Tag promotion. They will also be offered the chance to pre-order the track on iTunes or buy it immediately once it is released.
  4. The winner of the Take That 'Golden Tag' on Shazam will be chosen randomly by computer and the winner will be announced on Monday 29 November 2010.

The Terms and Conditions that govern this promotion are outlined below.   1. Eligibility Criteria - Participation in this promotion is limited to UK residents aged 18 or over excluding employees of Shazam Entertainment Limited ("Shazam") and or Universal Music Group ("Universal") and their affiliated companies, their agents or anyone professionally connected with or employed by or in any way connected with a company sponsoring or endorsing this promotion or their relatives. The winner's guest must also be aged 18 years or older.
  2. Promotion Period - This promotion will run between 5 October and 21 November 2010. Shazam will notify the promotion winner by email within a reasonable period upon the termination of the promotion period. If the promotion winner does not respond to the email communication for any reason within 14 days, or if the winner has provided inaccurate or incomplete email details upon registration with Shazam, or if the winner does not wish to take up the prize Shazam reserves the right to select an alternative entrant at random.
  3. Judging Criteria - The promotion winner will be randomly selected at Shazam's sole discretion. Shazam's decision is final. Shazam reserves the right to verify that the promotion winner and winner's guest meet the criteria listed in these Terms and Conditions to be eligible for this promotion.
  4. Promotion Details - The winner of the promotion will receive two tickets to attend a special 'Take That' performance and an exclusive face-to-face with the band. The exact location of the performance will be confirmed to the promotion winner by email to the email address provided upon registration with Shazam. The promotion winner and their guest will be solely responsible for travel to and from the venue, any necessary accommodations and all other expenses. NEITHER SHAZAM, 'TAKE THAT' NOR UNIVERSAL MAKES ANY WARRANTY WITH RESPECT TO THE APPEARANCE OF 'TAKE THAT' AT THE PERFORMANCE AND, FURTHER, ASSUME NO RESPONSIBILITY AND SHALL NOT BE LIABLE FOR ANY COSTS, CHARGES OR EXPENSES WHICH MAY BE REQUIRED TO PAY AT ANY TIME IN CONNECTION WITH THE PRIZE.
  5. Promotion Participation - All Shazam users will be entered into the promotion if, prior to the termination of the promotion period, such users have: (i) downloaded the Shazam iOS Application (available on: iPhone and iPod Touch) (the "Shazam App"); (ii) successfully tagged the 'Take That' track entitled, "The Flood" from within the Shazam App; and (iii) have EITHER registered for Shazam from within in the Shazam App on their mobile device OR registered for Shazam at http://www.shazam.com/ and subsequently signed in to their Shazam account from within the Shazam App.
  6. Promotion Alternative - No cash or other reward alternatives are available, except that in the event of circumstances outside of its control Shazam reserves the right to substitute an appropriate alternative reward to the promotion winner.
  7. Publicity - Promotion winner (and their guest) may be required to take part in unpaid, reasonable publicity relating to or in connection with this promotion. Shazam and/or Universal shall be entitled (but not obliged) to use the name, biography, likeness, signature, sound recording, photographs and film of entrants relating to or in connection with this promotion for any advertising, publicity or editorial purposes in any media throughout the world and the winner (and their guest) irrevocably consents to any such use.
  8. Additional Terms and Conditions - The performance tickets are provided by an independent third party (Universal) and are therefore subject to Universal's terms and conditions. Any additional terms of entry specified by the concert venue will also apply.
  9. Termination - Shazam and/or Universal reserves the right to terminate, amend or extend this promotion in wholly exceptional circumstances outside their control.
  10. Governing Law - This promotion is governed by English law and is subject to the exclusive jurisdiction of the English courts.
  11. Severability - If any provision of these Terms and Conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
